Terms of Service

These Terms of Service ("Terms") govern your use of Webend Creator at webendcreator.com (the "Service") operated by Summit Software Consulting ("we," "us," or "our"). By creating an account, you agree to these Terms.

1. Service description

Webend Creator is a multi-tenant SaaS platform providing a suite of studios (DataStudio, TemplateStudio, PilotStudio, TestStudio, AccessStudio, DocStudio) for low-code data and application tooling. The Service is delivered over the public internet from infrastructure operated by us and our subprocessors.

2. Accounts

You are responsible for safeguarding your account credentials and for any activity that occurs under your account. You agree to notify us immediately of any unauthorized access. You must be at least 18 years old to use the Service.

3. Acceptable use

You agree not to:

  • Use the Service for any unlawful purpose or in violation of any law or regulation.
  • Send spam, phishing emails, or other unsolicited messages through the Service.
  • Reverse-engineer, decompile, or attempt to extract the source code of the Service.
  • Interfere with or disrupt the integrity or performance of the Service or attempt to gain unauthorized access to it.
  • Use the Service to build a competing product.

4. Subscriptions and billing

Paid subscriptions are billed monthly on a recurring basis through our Merchant of Record, Paddle.com Market Limited. By starting a paid subscription you authorize Paddle to charge your payment method on each billing cycle until you cancel. Prices are listed at webendcreator.com/v/pricing and may change with at least 30 days' notice; existing subscriptions are honored at their then-current rate through the end of the current period.

New signups receive a 14-day free trial of the selected plan. No payment is required during the trial. If you do not subscribe by the end of the trial, the workspace transitions to the Free plan automatically.

5. Cancellation and refunds

You may cancel your subscription at any time from the Subscriptions page within your workspace. Cancellation takes effect at the end of the current billing period — you retain full access through the end of the period you've paid for. We do not provide pro-rated refunds for partial periods or unused time. See our Refund Policy for details.

6. Your content

You retain ownership of all data, configurations, and templates you create or upload to your workspace ("Your Content"). You grant us a limited license to host, process, and display Your Content solely to provide the Service. We do not access Your Content except as necessary to operate the Service, comply with law, or with your permission (e.g., a support request).

7. Service availability

We aim to provide reliable service but do not guarantee uninterrupted or error-free operation. We may perform scheduled maintenance and may need to take portions of the Service offline temporarily. We do not provide a formal Service Level Agreement (SLA) on standard plans.

8. Termination

We may suspend or terminate your access if you breach these Terms, fail to pay outstanding charges, or use the Service in a manner that creates legal exposure for us or other users. On termination, you have 30 days to export Your Content, after which we may permanently delete it.

9. Disclaimer of warranties

The Service is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.

10. Limitation of liability

To the maximum extent permitted by law, in no event will Summit Software Consulting be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, arising from your use of the Service. Our total cumulative liability for any claim arising out of or relating to these Terms or the Service is limited to the amount you paid us in the twelve months preceding the claim.

11. Governing law

These Terms are governed by the laws of the State of Oregon, United States, without regard to its conflict-of-law provisions. Any dispute arising from these Terms or the Service shall be resolved in the state or federal courts located in Oregon, and you consent to the personal jurisdiction of those courts.

12. Changes to these Terms

We may revise these Terms from time to time. We will notify you of material changes by email and/or an in-app notice. Continued use of the Service after the effective date of the revised Terms constitutes acceptance.
